Welcome to Zelawella. These Terms of Service ("Terms") govern your use of the Zelawella application and services operated by Ironmind Studios Inc. ("Company," "we," "us," or "our"). By accessing or using Zelawella, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Zelawella, you confirm that you:

• Are at least 13 years of age
• Have the legal capacity to enter into this agreement
• Agree to comply with these Terms and our Privacy Policy

2. Description of Service

Zelawella is an AI-powered wellness application that provides:

• Personalized wellness coaching through AI agents
• Integration with fitness tracking platforms (Fitbit, Garmin, and others)
• Health and fitness data visualization
• Habit tracking and motivation features
• Social wellness mechanics

3. Account Registration

To use Zelawella, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access
• Accept responsibility for all activities under your account

4. Third-Party Integrations

Fitbit Integration

By connecting your Fitbit account to Zelawella:

• You authorize us to access the Fitbit data categories you approve
• You acknowledge that your use of Fitbit is governed by Fitbit's Terms of Service
• You may revoke access at any time through Fitbit's settings or within Zelawella

Garmin Integration

By connecting your Garmin account to Zelawella:

• You authorize the transfer of your Garmin data to Zelawella
• You acknowledge that your use of Garmin Connect is governed by Garmin's Terms of Use
• You may revoke access at any time through Garmin Connect settings or within Zelawella

5. Acceptable Use

You agree not to:

• Use Zelawella for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Reverse engineer or attempt to extract source code
• Use automated systems to access the service without permission
• Impersonate others or provide false information
• Violate the rights of others, including privacy and intellectual property rights

6. Intellectual Property

All content, features, and functionality of Zelawella—including but not limited to our AI agents' personalities, text, graphics, logos, and software—are owned by Ironmind Studios Inc. and protected by intellectual property laws.

You retain ownership of your personal data. By using Zelawella, you grant us a limited license to use your data solely for providing and improving our services as described in our Privacy Policy.

7. AI-Generated Content

Our AI wellness agents generate personalized responses and recommendations. You acknowledge that:

• AI-generated content is for informational and motivational purposes only
• AI responses should not replace professional medical, fitness, or mental health advice
• AI may occasionally produce inaccurate or inappropriate content
• You should use your judgment when following AI recommendations

8. Disclaimers

AS-IS SERVICE: Zelawella is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

HEALTH DISCLAIMER: Zelawella is not intended to diagnose, treat, cure, or prevent any disease or health condition. The information provided is for general wellness purposes only.

DATA ACCURACY: We do not guarantee the accuracy of data received from third-party integrations like Fitbit or Garmin.

9. Limitation of Liability

To the maximum extent permitted by law, Ironmind Studios Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or health outcomes, arising from your use of Zelawella.

Our total liability for any claims arising from these Terms or your use of Zelawella shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Ironmind Studios Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of Zelawella or violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. You may delete your account at any time through app settings or by contacting us.

Upon termination:

• Your right to use Zelawella ends immediately
• We may delete your data in accordance with our Privacy Policy
• Provisions that should survive termination will remain in effect

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the app or via email. Continued use of Zelawella after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
